RE: The tariff classification of Lubiprostone (CAS-136790-76-6), imported in bulk form, from Taiwan

In your letter dated June 9, 2008, you requested a tariff classification ruling. We apologize for our delay in responding to you.
The subject product, Lubiprostone, is a gastrointestinal agent indicated for the treatment of idiopathic constipation and Irritable Bowel Syndrome with constipation (IBS-C).
The applicable subheading for the Lubiprostone will be 2937.50.0000, HTSUS, which provides for "Hormones, prostaglandins, thromboxanes and leukotrienes, natural or reproduced by synthesis; derivatives and structural analogues thereof, including chain modified polypeptides, used primarily as hormones: Prostaglandins, thromboxanes and leukotrienes, their derivatives and structural analogues." The rate of duty will be free.
